The recent investigation by Sky News and the Independent Patient 11 podcast has shed light on a disturbing reality within mental health inpatient wards in England. The investigation uncovered nearly 20,000 new complaints of sexual abuse, harassment, and rape involving both patients and staff across more than 30 mental health trusts since 2019. This revelation has prompted Rape Crisis England & Wales to call for a public inquiry into the prevalent issue of sexual violence and abuse within these facilities.
Rape Crisis England & Wales (RCE) has described the current situation as “appalling” and “alarming”. The organization is advocating for the government to appoint a minister responsible for the safety of women on mental health wards, establish women-only wards, and provide mechanisms for victims to give evidence. Without significant intervention and leadership at the highest levels, there is a risk of sexual violence and abuse becoming normalized, when it is entirely preventable.
RCE has been vocal about the urgent need for a public inquiry and has expressed concerns about the lack of progress in addressing safeguarding issues within the health system. Despite a damning Care Quality Commission report on sexual safety in 2018, little seems to have changed. The safety and well-being of women and girls, especially in their most vulnerable moments, must be a top priority for mental health facilities.
Gaps in Enforcement
According to the investigation, there have been instances where rape or sexual assault complaints involving female patients were not reported to the police. Additionally, mental health trusts have largely failed to implement government-backed protections from 2020. This lack of enforcement and accountability highlights a dire need for systemic change within these facilities.
One of the major concerns raised by RCE is the lack of clarity on the part of government and health leaders regarding the responsibility for ensuring sexual safety on mental health inpatient wards. This ambiguity leaves room for gaps in safeguarding measures and ultimately puts vulnerable individuals at risk. Political will, leadership, and collaborative solutions are essential in driving positive cultural change within these settings.
While the Department of Health and Social Care did not respond to the call for a public inquiry, it emphasized its zero-tolerance policy towards sexual assaults in NHS services. The department expects NHS trusts to comply with measures such as segregated sleeping accommodations and bathroom facilities. The Health Services Safety Investigations Body has also launched a national investigation into mental health inpatient settings to address these pressing concerns.
The NHS has taken steps to address sexual safety by launching the first-ever NHS sexual safety charter in collaboration with various healthcare organizations and individuals with lived experience. This charter aims to provide staff with clear reporting mechanisms, training, and support to ensure a zero-tolerance approach towards sexual misconduct. Over 250 organizations have already signed up to the charter, signaling a collective commitment to creating a safer environment within mental health facilities.
The findings of the investigation underscore the urgent need for a comprehensive public inquiry into sexual violence and abuse within mental health inpatient wards. It is imperative that government agencies, health officials, and stakeholders work together to implement robust safeguards, enforce accountability, and prioritize the safety and well-being of all individuals receiving mental health treatment.
