A recent case involving a Seattle-area plastic surgery provider has shed light on the importance of transparency and honesty in the plastic surgery industry. The provider, Allure Esthetic, and its owner Javad Sajan, MD, were accused of threatening patients over negative reviews and posting fake positive ones.
Legal Consequences
The state attorney general’s office filed a federal consent decree in response to these allegations. The decree mandates that Allure Esthetic pay $5 million to the state attorney general’s office and thousands of Washington patients. This resolution stems from a lawsuit brought by Attorney General Bob Ferguson, highlighting the severity of the allegations against the plastic surgery provider.
As part of the consent decree, Allure Esthetic is required to pay approximately $1.5 million in restitution to around 21,000 individuals. Those who were forced to sign illegal nondisclosure agreements (NDAs) will receive $50 each, while individuals who paid a nonrefundable consultation fee before signing an illegal NDA will receive $120. The remaining $3.5 million will go towards attorney fees, litigation costs, and monitoring and enforcing the consent decree.
Consumer Trust and Safety
Attorney General Bob Ferguson emphasized the importance of consumer trust and safety in the context of plastic surgery services. He stated that consumers rely on reviews to make informed decisions about their health and safety, and that writing a truthful review should not result in threats or intimidation. The resolution against Allure Esthetic is intended to hold the provider accountable for violating consumer trust and the law.
Allure Esthetic’s attorney, Erin M. O’Leary, expressed that the decision to settle was not easy but the company is pleased to have resolved the case. O’Leary stated that the cooperative settlement, while not admitting fault, allows Allure Esthetic to continue focusing on providing compassionate care to patients. This response raises questions about the company’s commitment to ethical practices moving forward.
Lessons Learned and Moving Forward
The case of Allure Esthetic serves as a cautionary tale for the plastic surgery industry. It underscores the importance of transparency, honesty, and ethical conduct in providing medical services to consumers. Moving forward, it is crucial for plastic surgery providers to prioritize integrity and accountability to ensure the safety and well-being of their patients.
