The National Labor Relations Board has filed a complaint accusing Tesla of taking steps to discourage its employees from forming or joining a union. This complaint, brought forth by the NLRB’s regional director Linda Leslie, highlights the company’s alleged efforts to prevent workers from engaging in concerted activities related to unionization.

According to the complaint obtained by CNBC through a Freedom of Information Act request, Tesla implemented an acceptable use policy for workplace technology in 2023 that aimed at restricting employees from activities such as recording, unauthorized soliciting, and creating channels for communication. The NLRB argues that this policy effectively interfered with the rights guaranteed to workers under the National Labor Relations Act, which protects the freedom of employees to discuss organizing, join a union, and collectively negotiate for better working conditions.

The situation at the Tesla Buffalo plant is further complicated by recent layoffs and restructuring efforts within the company. Last month, Tesla announced job cuts affecting 285 employees in New York, with a significant portion of those layoffs occurring at the Buffalo factory. These layoffs come as Tesla faces declining electric vehicle sales in the first quarter and undertakes a broader restructuring to streamline its operations.

Past Confrontations with Unions

Tesla and its CEO, Elon Musk, have a history of clashing with union proponents and facing allegations of labor law violations. In 2021, the NLRB found Tesla guilty of violating labor laws by firing a union activist. Moreover, Musk’s controversial statements on social media, such as questioning the need for union dues, have drawn criticism and legal action. Despite challenges and orders to remove such posts, Musk’s remarks on social media remain visible to his millions of followers.

International Labor Issues

The labor challenges faced by Tesla are not limited to the United States, as evidenced by recent strikes in Europe. Swedish service technicians initiated a strike last year, seeking a collective bargaining agreement with Tesla. The ongoing strike in Sweden reflects broader tensions between Tesla and organized labor in European countries where union membership is more common and workers’ rights are strongly protected.

The controversy surrounding Tesla’s union practices highlights the complex relationship between the company, its employees, and organized labor.
